part because they believe that rice lied to make it seem less than it really was leading up to the election. floating senator kerry's name out there, he is supported by a lot of the same people attacking rice. is there political gamesmanship going on right here? >> there certainly could be some element of that going on. i think there is some particularly in mccain's position a great deal of history there with susan rice. it is interesting that they want to make this stand on again benghazi because there were, indeed, problems, things to be probed about what actually occurred over there in libya. but the idea of going after her and disqualifying her for secretary of state because she read out talking points on a sunday talk show is kind of a difficult argument to make. >> and i think that's what the majority of the public has sort of trouble reconciling, which is, look, when news is breaking, everybody sort of goes with what they've got and then has to readapt it. why there's so much anger against her is confusing to a lot of people. dana milbank, nice to have you on with us. >> my pleasure.

>> you know, after this election, this issue is so ripe for the supreme court the jurisdictions are so split in their laws, many states recognizing same-sex marriage and performing same-sex marriages. some states not recognizing them. this is the perfect scenario for the supreme court to step in and ultimately make a ruling. there are over 1,000 cases, joe, in which federal laws are impacted by marital status. the time has come. it's ripe. prop 8 was on the doorstep for the supreme court. here we go. >> avery, we were trading e-mails a little bit a while ago. one of the questions i asked you was whether the supreme court essentially gave itself an emergency escape hatch with one of the cases it chose. can you talk about that? >> late yesterday, as you know, joe, the supreme court amended its grant of review when it said, we want to know about the issue of standing. meaning does the person involved in the challenge have the right to be there in the first place. if the court doesn't then what it means in practical terms is if you don't have the right to be in court, you don't have standi

on friday, we'll get our first post election look at how many jobs are being created. and the early forecasts are not good. cnn money forecasts just 77,000 net jobs created in november. that's far fewer than the 171,000 that were added in october. a lot happened last month. superstorm sandy, labor turmoil at hostess and business uncertainty because our elected officials won't get their act together and deal with the fiscal cliff. brace yourself for a job number that could be even lower than the already weak forecast. i hope i am wrong about that. from the cnn money newsroom in new york, i'm ali velshi. that's it from me. same time tomorrow. i plugged in snapshot, and 30 days later, i was saving big on car insurance. with snapshot, i knew what i could save before i switched to progressive. the better i drive, the more i save. i wish our company had something this cool. you're not filming this, are you? aw! camera shy. snapshot from progressive. test-drive snapshot before you switch. visit progressive.com today. plays a key role throughout our lives. one a day men's 50+
